1.书面形式 聘用合同须以书面形式确定,任何口头协议都将视为无效
2.签订合同 合同签署时间应在外教来华前,已在华的应在入职之前;出于综合考虑,我们建议如果受聘外教在国外,应在受聘外教来华前签订正式合同。如果受聘外教在我国境内, 应该在受聘外教到职前签订正式合同。
3.签订人 签署人应为法人代表或法人代表所授权的人。被授权者应有授权书,其他人签字的合同均视为无效合同。
4.合同期限 合同期以一年为宜,但连续在华合同期总计不宜超过五年。
5.合同更改 当事一方要求修改原合同,须经双方协商一致,以文字形式确认修改或增删的内容,未达成一致意见以前,应仍按原合同条款执行,直至合同期结束。
